1. Scope

These General Terms and Conditions apply to all contracts and agency services between Maximilian Bauer, trading as ‘Auslandssemester-Bali’, and customers who enquire about or book accommodation in Bali via the website.

The service is aimed at all customers, regardless of whether they are students, working professionals or other individuals.

2. Scope of the service

Auslandssemester-Bali arranges accommodation in Bali between customers and the respective landlords or accommodation providers.

Auslandssemester-Bali is not itself the landlord or operator of the accommodation featured on the website.

The relevant tenancy agreement is concluded between the customer and the respective landlord or operator of the accommodation, unless otherwise expressly agreed in individual cases.

Auslandssemester-Bali helps customers choose and arrange accommodation, as well as liaise with the relevant landlord.

3. Information about the accommodation

The information, prices, images and descriptions shown on the website are provided to the best of our knowledge and belief.

As the accommodation is managed by different landlords, individual details, facilities, prices or availability may vary.

The respective landlord or operator is generally responsible for the actual provision of the accommodation service.

4. Booking and conclusion of contract

An enquiry via the website is initially a non-binding enquiry from the customer.

A binding booking is made as soon as the availability of the desired accommodation has been confirmed and the customer has expressly confirmed the booking or the relevant offer.

Once the booking has been successfully completed, the customer will receive a confirmation containing the key booking details.

5. Prices and Payment

The total price quoted at the time of booking must be paid by the customer within the specified payment period.

Unless another payment method has been expressly agreed, payment shall be made by bank transfer.

The fee for the semester abroad in Bali may form part of the total price payable by the customer and is not necessarily shown separately to the customer.

The commission or agency fee charged by Auslandssemester-Bali is agreed with the relevant landlord or contractual partner.

6. Cancellation and Withdrawal

By making a binding booking, the customer agrees to pay the agreed amount.

Cancellation after a binding booking has been made is generally not permitted, unless a different arrangement has been expressly agreed in the relevant booking offer or in the contract with the landlord.

The customer’s statutory rights remain unaffected by this.

Should accommodation not be available as agreed due to circumstances for which the landlord is responsible, Auslandssemester-Bali will endeavour to find a suitable solution or alternative accommodation.

7. Availability

Accommodation availability is subject to change at any time.

Accommodation is only considered to be definitively booked once availability has been confirmed by the relevant landlord and the booking has subsequently been confirmed accordingly.

In the case of accommodation where final availability depends on the renewal of an existing tenancy, the customer will be informed of this before making a binding booking.

8. Landlord’s responsibilities and obligations

The respective landlord or operator is generally responsible for the actual provision and condition of the accommodation.

This includes, in particular:

the provision of the booked accommodation,
the agreed facilities,
the handover of the accommodation,
compliance with the agreed tenancy period,
the refund of agreed deposits,
as well as the rectification of defects, insofar as these fall within the landlord’s remit.

Auslandssemester-Bali supports customers with any issues and can mediate between the customer and the landlord.

9. Changes made by the landlord

Should the landlord make changes to the accommodation after a booking has been confirmed, or be unable to provide the accommodation as agreed, Auslandssemester-Bali will inform the customer and endeavour to find a suitable solution.

There is no entitlement to specific alternative accommodation unless this has been expressly agreed.

10. Behaviour in the accommodation

The customer undertakes to treat the accommodation and its facilities with care and to comply with the house rules laid down by the landlord.

The customer may be liable to the relevant landlord for any damage caused through the customer’s own fault or by people invited by the customer.

11. Liability of Auslandssemester-Bali

Auslandssemester-Bali is liable for damages in accordance with statutory provisions.

To the extent permitted by law, Auslandssemester-Bali shall not be liable for any damage or disruption arising solely from the services provided by the respective landlord or operator and for which Auslandssemester-Bali is not responsible.

Liability for damages resulting from injury to life, limb or health, as well as for damages caused intentionally or through gross negligence, remains unaffected.

12. Faults and complaints

Any faults or problems with the accommodation should be reported by the customer immediately to the landlord and, where possible, also to Auslandssemester-Bali.

As part of its agency services, Auslandsemester-Bali will endeavour to find a solution in collaboration with the landlord.

The customer’s legal claims against the relevant contractual partner remain unaffected.

13. Data Protection

Personal data is processed in accordance with statutory data protection regulations and the privacy policy published on the website.

In order to process the booking, the details required for the booking may be passed on to the relevant landlord or accommodation provider.

14. Final provisions

Should any individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.

The statutory provisions apply.

Any individual agreements between the customer and Auslandssemester-Bali or the relevant landlord take precedence over these General Terms and Conditions.
